BOAT RULES
RESERVATIONS
Open Boot Deep Sea Fishing and Iron Man Offshore trips require full payments at the time of booking.
All Private Deep Sea Fishing, Tuna, Shark, and Private Charters reservations require a (non-refundable) 50% deposit at the time of booking to save your charter date aboard the Touch of Gray.
The balance is due 14 days before your scheduled Private Deep Sea Fishing date. Be sure to inform the Captain of any medical concerns or special requirements at the time of booking.
The Touch of Gray goes fishing in the rain and when the wind blows so be prepared and bring proper clothing. The fish don’t know it’s raining because they are already wet!! The Captain may cancel the trip the night before or the morning of the fishing trip due to bad weather and sea state. The SAFETY of the PASSENGERS and CREW is PARAMOUNT. It’s not always about the money!

WHAT TO BRING
While the wheelhouse of the boat is dry and warm, it can only hold 6 customers. Because of this, it is necessary to bring the appropriate clothing for the season. Please call the captain a day or two prior to your charter for the weather forecast.
The Captain recommends the following items for your charter:

Warm clothes, dress for the weather forecast (while it may be 80 degrees at the pier, it will be much cooler on the water)

Sea sickness or motion sickness, over-the-counter medication if needed, or contact your Doctor about the Scopolamine patch (highly recommended.) Follow the directions on the medication package.

No pets are allowed other than bonafide service dogs, no emotional support animals are allowed.
DEPOSIT
Private Deep Sea Fishing, Tuna, Shark, and Private Charters all require a 50% NON-REFUNDABLE deposit. This reserves the Touch of Gray for the date that you select for your specific charter.
The balance is due 14 days prior to your private charter date reserved. Failure to pay the balance of your private charter will result in your private charter being cancelled for non-payment.

GRATUITY
On the Touch of Gray we take you out 20 plus miles into the deep waters of the Gulf of Maine for the ultimate fishing adventure. We provide high-end equipment, an experienced captain and first mate who guide you through your fishing experience. We are dedicated to providing the best service and making sure your time spent with us is as enjoyable and memorable as possible.
What sets us apart from the rest of the fleet is our attention to detail, the emphasis on customer service and a genuine fishing passion coupled with our willingness to transfer our knowledge to you our valued customer. A 15-20% percent gratuity for the first mate is customary and is an industry standard. The first mate is much like your favorite waitress / waiter or bartender except they only serve you for 45/60 minutes. The first mate on the Touch of Gray typically works a solid 10-12 hour long day to ensure that your deep sea fishing adventure and experience in the Gulf of Maine is second to none. When you love what you do it's not work!

REFUNDS
Refunds will not be issued to customers who DON'T show up. A full refund will be issued or (applied to a future activity) should your trip or activity be canceled due to bad weather or due to a mechanical issue with the vessel. The Captain reserves the right to terminate ALL Fishing Trips and Private Charters at any time without refund.

DEPARTURE TIMES
The Touch of Gray leaves the dock PROMPTLY at 0630 for all scheduled Open Boat Deep Sea Fishing trips and Private Deep Sea Fishing trips unless other arrangements * have been made and agreed upon in writing or by email. All passengers and guests are required to check in at 0600 SHARP for all deep sea fishing trips *. There is NO reason for missing the boat, Time and Tide wait for no man and neither does the fine vessel Touch of Gray. We will not wait for ANYONE that is late. It is your responsibility to show up on time. It is not fair to make the rest of the boat lose fishing time due to one passenger or group being late to the boat.
THIS POLICY WILL BE STRICTLY ENFORCED AND THERE ARE NO EXCEPTIONS.

SEATING
Deep-Sea Fishing trips are open boat, which means it is open to the general public. There is no assigned seating onboard the Touch of Gray, however, if you pick a spot it’s yours for the day on the Touch of Gray. The wheelhouse is limited to six (6) passengers for safety reasons. Should you want a more personal experience for a family or large or small group a private charter is the best option.

FISHING & THE CATCH
A fishing license is not needed to fish onboard the Touch of Gray. All fish, including Bluefin Tuna that are permitted to be CAUGHT by the Touch of Gray in accordance with current state and federal regulations are the property of the customer or group and shall be filleted and packaged by the Mate. With regards to large Bluefin Tuna greater than 73 inches in length, these fish will be retained by the boat due to Federal regulations, please inquire with the Captain.
Fish sizes and limits are strictly adhered to under all state and federal regulations, so don’t ask for exceptions. The Maine Marine Patrol conducts vessel compliance checks frequently.

GUARANTEE
There are NO guarantees in life other than death and taxes!! Anyone that advertises or brags that they guarantee you will catch XXX number of fish is not truthful. It is highly probable that you will certainly catch fish and have an enjoyable time making unforgettable memories of your fishing experience onboard the Touch of Gray. Honesty is the best policy!

BAIT & TACKLE
All Tackle and gear are provided. Bait is not provided nor required but customers can bring their own. The captain reserves the right to stop using bait at his discretion due to fishing conditions and the presence of dogfish. Customers who bring their own equipment are limited to 1 fishing rod per person and use it at their own risk. The Touch of Gray uses all Penn rods and reels for all Deep-Sea Fishing Trips. The Touch of Gray uses custom-built extra-long 130 class rods and Penn International 130H reels for Tuna and Shark Fishing Trips.
All lost gear and tackle by the customers will be charged to the customer at replacement value.

Customers are responsible for lost gear and/or damaged equipment and will be charged accordingly.
RESTRICTIONS
​Age: Children between 8-17 must be accompanied by an adult family member.
Alcohol: You are going fishing not drinking.
NO HARD ALCOHOL ALLOWED, beer and wine are allowed in moderation. If you show up intoxicated you will not be allowed to board the vessel and you will not be refunded your booking. If you become intoxicated while out to sea you will be asked to take a seat for the remainder of the trip, you will not be allowed to fish and will be asked to take a seat.
Drugs: NO DRUGS ALLOWED PERIOD. The Touch of Gray is a DRUG FREE VESSEL.
Smoking: Is allowed at the stern of the vessel. Please have respect for the other passengers as they will have respect for you.
Language: Please refrain from foul or lewd comments or talk and please have respect for the other passengers. The Touch of Gray is a family-oriented business, women and young children often come fishing.

SAFETY & GEAR
SAFTEY EQUIPMENT:
All safety equipment meets or exceeds USCG Safety Requirements!
The Touch of Gray’s safety equipment consist of an EPIRB, Lifejackets, Life rings and Fire Extinguishers, 2 VHF radios, Satellite Phone and a 100 mile compliant Flare kit ana 25 man IBA (Inflatable Buoyant Apparatus).
ELECTRONICS:
The Touch of Gray has state of the art radar, gps, fishfinder, vhf radios and satellite communications.

PERMISSION
Permission:
Any customer hereby grants Touch of Gray Charters the right to use any and all photographs or likeness in any and all forms of media, including but not limited to print, online, and social media, for the purpose of promoting The Touch of Gray Charters. You understand that your photo may be used in advertising materials, website content, and other promotional materials.
Please note that you are not entitled to any compensation for the use of any photograph or likeness, and that the use of your photograph or likeness will not constitute any infringement or violation of any personal or property rights of any kind.
You will certify that you are over 18 years of age and have read and fully understand the terms of this release.
Please note that at no time will any crew of the Touch of Gray Charter take photographs or likness therin of any minors.
